According to the "Decision of the State Council on the decision to establish an administrative license for administrative approval items that need to be retained" and the "Automobile Industry Development Policy," the Ministry of Industry and Information Technology has formulated the "Regulations for the Administration of Commercial Vehicle Manufacturing Enterprises and Product Access." To be announced, please follow the implementation of the relevant units.

This rule will come into effect on January 1, 2011. After the implementation of this rule, inconsistent with this rule, this rule shall prevail.

Commercial Vehicle Manufacturing Enterprises and Product Entry Management Rules

Chapter 1 General

Article 1 regulates the access management of commercial vehicle manufacturing enterprises and products, maintains the order of market competition for commercial vehicle products, promotes the adjustment and optimization of the automobile industry structure, and promotes technological advancement of enterprises, according to the “State Council’s decision on the need for administrative approval. The relevant provisions of the Decision on the Determination of Administrative Licensing, the "Development Policy for the Automobile Industry" and the "Regulations for the Adjustment and Revitalization of the Automobile Industry" shall be formulated.

Article 2 These rules apply to companies engaged in the production of commercial vehicle products for domestic use within the territory of the People's Republic of China (hereinafter referred to as commercial vehicle production enterprises) and commercial vehicle products produced by them.

The term "commercial vehicle products" as mentioned in the present Rules refers to paragraph 2.1.2.1 (passengers) and 2.1 of the National Standard GB/T 3730.1-2001 "Types and Definitions of Vehicles and Trailer Types" that are used for self-made vehicles (including chassis). Section 2.2.2 (Semi-trailer tractors), Vehicles as defined in paragraph 2.1.2.3 (Trucks).

This rule also applies to paragraph 2.1.2.1 (Bus) in the National Standard GB/T 3730.1-2001 "Types and Definitions of Automobiles and Trailer Types" that are manufactured on the basis of purchased complete vehicles or Type II or Type III chassis. The defined vehicle is a modified passenger car.

Article 3 The Ministry of Industry and Information Technology shall be responsible for the implementation of the management of the entry of commercial vehicle manufacturers and commercial vehicle products.

Chapter II Access Conditions and Management

Article 4 The Ministry of Industry and Information Technology implements classified management of commercial vehicle manufacturing enterprises and product access in accordance with the category of commercial vehicle products. Commercial vehicle production enterprises shall organize the production and sales of corresponding products according to the approved product categories.

Commercial vehicles are divided into trucks and passenger cars according to their product categories. Among them, trucks include light goods vehicles, medium and heavy goods vehicles, and passenger car products include light passenger cars (including modified cars) and large and medium passenger cars (including modified cars). Commercial Vehicle Category Classification Table (Annex 1).

Article 5 An investment project of a commercial vehicle manufacturing enterprise shall apply for entry after it has gone through the project approval formalities in accordance with the Automobile Industry Development Policy and the relevant state investment management regulations.

Article 6 Entry conditions for commercial vehicle production enterprises:

(1) It complies with national laws, regulations, relevant regulations, and national industrial policies and macroeconomic control policies.
(B) have a certain scale and the necessary production capacity and conditions.
(C) have the necessary product design and development capabilities.
(d) The products produced comply with the relevant national standards and regulations.
(five) have the ability to ensure the consistency of product production.
(six) have product sales and after-sales service capabilities.

Those who apply for access to a commercial vehicle production enterprise shall meet the specific access conditions stipulated in the "Entry Conditions and Requirements for the Inspection of Commercial Vehicle Production Enterprises" (Annex 2, hereinafter referred to as "Entry Conditions").

Large-scale automobile enterprise groups with certain conditions, under the premise of unified planning, unified management, and corresponding supervision responsibilities of enterprise groups, the conditions of access for their subordinate enterprises (subsidiaries and branches) can be appropriately simplified. Access requirements and review requirements for group companies (Annex 3).

For the production capacity and facilities requirements of various types of commercial vehicle manufacturers, see the “Production Conditions and Equipment Requirements for Commercial Vehicle Enterprises” (Annex 4).

Article 7 Admission conditions for commercial vehicle products:

(1) Commercial vehicle products meet relevant standards and regulations for safety, environmental protection, energy conservation, and anti-theft.
(2) Commercial vehicle products have passed the inspection by the testing organization designated by the Ministry of Industry and Information Technology (hereinafter referred to as the testing organization).
(3) Commercial vehicle products do not infringe other people's intellectual property rights.

Article 8 To apply for entry into a commercial vehicle production enterprise, the following materials shall be submitted:

(1) Two copies of "Application Form for Admission of Commercial Vehicle Manufacturing Enterprises" (Annex 5).
(2) A copy of the business license of the legal person (or the supporting documents in the process of processing), and the Chinese-foreign equity joint venture shall also submit proof of the proportion of shares held by Chinese and foreign shareholders.
(3) quality manual (full text) and procedure documents (directory), copy of quality system certification certificate or recent quality system certification plan.
(4) Explanations on the company's ability to design, produce, market, and provide after-sales services for commercial vehicles, parts supply systems, and production conformity assurance capabilities.
(5) Explanations on the establishment of a company that meets the "Development Policy for the Automotive Industry."
(6) The project approval or filing documents handled in accordance with the relevant state investment management regulations.
(7) Test report on commercial vehicle products issued by the testing agency.

Article 9 To apply for admission of commercial vehicle products, the following materials shall be submitted:

(1) A description of the basic situation of a commercial vehicle manufacturer, including the name of the company, shareholders, legal representative, registered trademark, registered address, and production address.
(b) Brief introduction of commercial vehicle products.
(3) Parameters of "Vehicle Production Enterprises and Products Announcement".
(4) "Main Technical Parameters and Main Configuration Record Form for Vehicles".
(5) Plan for Compulsory Inspection of Vehicle Products.
(6) Test report on commercial vehicle products issued by the testing agency.
(7) Other certification documents concerning commercial vehicle products.

Commercial vehicle production enterprises shall submit application materials for commercial vehicle product access through the information system designated by the Ministry of Industry and Information Technology.

Article 10 If a modified passenger car manufacturer intends to apply for production chassis access, it shall comply with the relevant requirements of the "Modified Passenger Car Manufacturing Enterprise Applying for Manufacturing Chassis Access Conditions" (Annex 6) and "Access Conditions".

Article 11 A commercial vehicle manufacturer that has obtained access prior to the issuance of these Regulations changes its basic conditions or ability conditions (including corporate restructuring, change of company name, change of equity or shareholder, change of legal representative, change of registered address or Where the production address, product variety or production address, etc., are applied to the Ministry of Industry and Information Technology for a change, the following part or all of the application materials shall be submitted:

(1) Changes in the relevant conditions of the company or the application for merger and reorganization.
(b) Articles of Association, mergers and acquisitions agreements, and joint venture agreements.
(3) The resolutions of the employee representative assembly, the board of directors or the general shareholders' meeting.
(4) The enterprise changes involve the application at the time of project construction and the approval and filing of relevant departments, and the changes of the enterprise are in line with the “Automotive Industry Development Policy”.
(5) The relevant approval documents issued by the asset management department to which the enterprise belongs.
(6) A copy of the business license before and after the change of the company.
(7) The report on the self-assessment conducted by the enterprise against the "access conditions".
(8) List of products included in the "Vehicle Production Enterprises and Products Announcement" and product change plan.
(9) Other relevant circumstances and supporting materials that need to be explained.

The Ministry of Industry and Information Technology shall assess the enterprise that has applied for the change in accordance with the specific access conditions stipulated in the "Entry Conditions"; if it fails to meet the conditions for access specified in the "Entry Conditions," it will suspend its declaration of New Products or suspension. Article 12 Commercial vehicle production enterprises shall continue to meet the requirements for access conditions and production consistency supervision and management measures, and normally carry out business activities such as production and sales. Chapter III Supplementary Provisions

Article 13 The rules are to be interpreted by the Ministry of Industry and Information Technology.

Article 14 The rules shall come into effect on January 1, 2011.

5 Production program: no less than 10,000 heavy trucks, no less than 50,000 medium-sized trucks, no less than 100,000 light trucks, no less than 5,000 large and medium-sized passenger buses and no less than 50,000 light passenger vehicles.
The annual production volume of commercial vehicle products of enterprises should be commensurate with the requirements for obtaining access permits.
6* The production equipment and special tools and molds necessary to ensure product quality and production capacity should be available.
The truck manufacturer shall have the manufacturing capabilities of the vehicle, cab, frame (chassis), and car/carriage.
Passenger car manufacturing enterprises should have the manufacturing capabilities of complete vehicles and bodywork, among which manufacturing bus companies should also have manufacturing capabilities for frame (chassis).
The requirements for the production capacity and facilities of various types of commercial vehicle enterprises are detailed in Annex 4 “Production Requirements and Equipment Requirements for Commercial Vehicle Enterprises”.

Three product design and development capabilities
9* A dedicated product development agency should be set up to take charge of the entire process of product design and development. The products developed and produced comply with the legal provisions on the protection of intellectual property rights.
10* Should be equipped with professional and technical personnel suitable for design and development tasks to understand the development of similar technologies at home and abroad; to be able to track and convert national standards, related industry standards, and national regulations; developers include product planning and Professional technicians in vehicle design, system and assembly component design, trial production, testing and inspection, standard regulations, intelligence information, intellectual property rights and patents.
The vehicle design includes vehicle model development, body/cab structural design, chassis structure design (not applicable to modified passenger car companies), vehicle matching design, and overall vehicle layout design.
The system design includes power systems, drive systems, and brake systems (all of which are not applicable to modified passenger car companies); it also includes steering systems, load-bearing systems, electrical instrumentation lighting systems, automotive electronics, and electronic control systems.
The assembly design of the assembly includes the entire process design capability of the company's own main assembly components.
The proportion of professional and technical personnel engaged in product development to the total number of employees is not less than 5%.
11 The product design and development work flow, design specification and work instructions for the enterprise should be established. The content of the product should cover the development process of the product and manufacturing process, including technical document management, standardization, etc., and be applied in practical work.
A product information database suitable for the product should be established. The database should include the basic data of the design platform, the parameters of the entire vehicle and chassis, the design of the assembly component parameters, calculations and analysis results.
A product standard system should be established. The requirements in the technical standards of enterprise products should not be lower than the relevant national standards and industry standards, and the filing procedures should be handled in accordance with regulations.
The design and development of 12* products should undergo a complete and multi-stage verification (including necessary test verification) and meet the requirements of national standards, industry standards, and design assignments.
Enterprises should have the ability to design and develop products (including complete vehicles and chassis, self-made assembly components), trial assembly capabilities for complete vehicles and self-made components, and necessary testing capabilities.
For light trucks, medium and heavy trucks, and light bus companies, trial assembly capabilities for complete vehicles and self-manufactured components include model car production, trial fabrication of body/cab structural parts or rapid prototyping, body/cab welding, chassis/frames Trial production (does not apply to converted passenger car companies), cab/chassis test (not applicable to converted passenger car companies), test vehicle assembly capability, and flexible processing capability of self-made parts.
For large and medium-sized bus companies, trial assembly capabilities for complete vehicles and self-made components can be combined with the passenger car production process.
Test validation capabilities for complete vehicles and self-made components include vehicle dynamics, economy, steering stability, braking performance, passability, comfort, noise and emissions (site testing), reliability, durability, and self-made parts The test conditions for performance, reliability, and fatigue performance.
For light trucks and light bus companies, the test verification capabilities also include complete vehicle performance test rooms, vehicle emission test chambers, vehicle environmental resistance test chambers, engine performance test rooms, and automotive parts environmental resistance test chambers.
13 The input and output of product and manufacturing process design and development shall be adequately suitable; the output of product and manufacturing process design and development shall be reviewed, verified and confirmed, and the corresponding records shall be kept. The product drawings and related technical documents formed by the design output shall be complete and can guide the production.
14 Before the implementation of design changes in products and manufacturing processes (including changes caused by suppliers), the review shall be re-evaluated (including assessing the impact of the changes on the product components and the delivered product), confirmation, verification if necessary, and Meet production consistency requirements.
Records of reviews, verifications, and confirmations should be kept, including changes to the dates of implementation in production.
Four product compliance
The products developed by 15* should verify the conformity of national standards, industry standards, and relevant national regulations. The verification work can be carried out autonomously. The verification of national mandatory standards is conducted by testing organizations.
The products produced by 16* should conform to the product consistency requirements, that is, consistent with the contents of the announced model information, type test prototypes and product certifications, and the tolerance values ​​of the product technical parameters should be within the allowable range.
Five product production consistency assurance ability
17 Enterprises should establish a quality management system in accordance with the requirements of ISO 9001 or an equivalent standard, and pass third-party certification. The certification certificate should be within the validity period and cover the product range applied by the enterprise. When adding a new business application, it is allowed to submit only the quality system certification plan, but it must obtain the quality system certification of the third party that meets the above requirements within 12 months after the approval of the approval. Enterprises should prepare a production consistency assurance plan.
18 Personnel ability evaluation and assessment systems related to product quality should be established and implemented, and appropriate records should be maintained.
Personnel related to product quality should have corresponding qualifications, professional skills and knowledge, and work in strict accordance with program documents, process documents or related work instructions.
19 Equipment and auxiliary inspection tools such as incoming inspection, process inspection and factory inspection necessary to ensure product quality should be available. The inspection project covers the main technical parameters of the vehicle, the basic technical parameters of the main components, and the inspection contents of the functions and performances. The indicators should meet the requirements of relevant technical standards and be consistent with the required measurement capabilities.
The inspection equipment (including relevant procedures and software) shall be controlled and calibrated or verified at a predetermined time interval or before use; when the inspection equipment is found not to meet the requirements, the validity of the previous measurement results shall be evaluated and Inspection equipment and related products take appropriate measures.
20* A certificate management system and a certificate information database shall be established to produce and issue product certifications that meet the requirements in accordance with the relevant provisions of the certificate management, upload the certificate information within the specified time limit, and save the certificate production and release records.
21 A complete product traceability system from the key component assembly supplier to the entire vehicle must be established. A complete vehicle product information and factory inspection data recording and storage system shall be established, in which the basic vehicle information archival period is the design service life of the vehicle; and the product inspection and test data archive period is not less than 2 years.
When major common problems and design defects occur in product quality, safety, and environmental protection (including problems due to supply side), the cause should be quickly identified, the scope of recall should be determined, and necessary measures must be taken; when customers need to repair spare parts Should be able to quickly determine the technical status of the required spare parts.
22 In the process of product realization, it is necessary to develop inspection specifications, inspection instructions for purchase inspections, process inspections, and factory inspections for parts and assemblies involving important characteristics, safety characteristics, and environmental characteristics, and to implement monitoring and measurement activities in accordance with regulations. .
For key processes and special processes, there should be clear process requirements and control methods, work instructions, standard operating procedures, and process monitoring and measurement.
23 A supply chain management system should be established, evaluation criteria determined, suppliers and their products evaluated and selected, and daily supervision and management performed. The supplier's evaluation, selection, and management records should be retained.
24 Identify, record, evaluate and dispose of unqualified items found in the procurement process, production process, delivery process, and customer feedback; if the safety and environmental performance of key components do not meet the requirements, do not allow concessions.
25 When the company's production consistency guarantee capability (including personnel capacity, production/inspection equipment, purchased raw materials and parts assemblies and suppliers, production technology, working environment, management system, etc.) has undergone major changes, there must be sufficient The evidence shows that the product still meets the original requirements.
Six product marketing and after-sales service capabilities
26* A complete documented after-sales service management system should be established, including service policies, service processes, service network construction, information feedback, product recalls, and customer management. Must have the ability to implement and monitor the implementation status.
27 It is necessary to establish and implement related personnel training systems for product marketing and after-sales services, customers, etc. Marketing and after-sales service system personnel should be able to provide customers with appropriate technical advice, technical training, and maintenance services.
28 It is necessary to establish an enterprise product warranty service component guarantee management method, and if necessary, jointly purchase the key component suppliers to jointly provide after-sales services for the product.
After-sales service, spare parts supply meets all customer requirements and can guarantee to provide customers with spare parts, maintenance and consulting services within the service life of the product within the limited service time.

Second, review requirements

1. Items marked with "*" are rejected.

2. The review of the applicable clauses can be appropriately simplified based on the circumstances such as the entry review or supervision and inspection, the nature of the enterprise application, etc. among them:

(1) In the case of an enterprise undergoing a change review (hereinafter referred to as a change review) due to the changes listed in Article 11 of this rule, Articles 3 and 5 of the access conditions are not evaluated.

(2) When a project is approved, the manufacturer of a commercial vehicle that has production requirements for an engine shall also be assessed Article 7 when conducting an entry review or change review. Other companies do not assess;

3. Review the principle of determination:

(1) When the contents of a certain clause do not meet the requirements, the clause is regarded as non-conforming;

(2) All rejected items are in compliance with the requirements. The proportion of non-conformities in general items does not exceed 20% of the number of general items subject to review. The conclusion of the review is passed; the others are not passed;

(3) When the conclusion of the review is not passed, the applicant company can rectify the nonconformity within 3 months. If the acceptance meets the requirements of Article 2, the review conclusion is passed; the acceptance does not meet the requirements of Article 2 The conclusion is not passed. Rectification and acceptance can only be performed once.

4. Supervision and inspection requirements:

(1) All vetoes other than Article 3 and Article 7, Article 14 (Design Change Record) and Chapter 5 "Product Production Consistency Guarantee Ability" (Articles 17 to 25) are supervision The mandatory inspection clauses; for the production of commercial vehicles that require the production of the project at the time of approval of the production of commercial vehicles, Article 7 is the mandatory inspection and inspection requirements;

(2) The non-conformity clauses in the access examination or the last supervision and inspection are the mandatory clauses for supervision and inspection;

(3) Other general items shall be examined according to the proportion of not less than 20%, and shall cover the changes of relevant activities within the operating cycle of the enterprise;

(4) For the newly-built commercial vehicle manufacturing enterprises after the implementation of these Regulations, the supervision and inspection shall include the inspection of whether the requirements of Article 3 and Article 5 are satisfied.

Annex 3:

Entry Requirements and Examination Requirements for Subordinate Enterprises of Automobile Enterprise Group

1. Product design and development capabilities

If the enterprise group has the ability to design and develop a common and common product platform (including product trial assembly capabilities and test verification capabilities), the subordinate enterprises can borrow and simplify the “three product design and development capabilities” in the “access conditions”. Claim.

However, the subordinate enterprises should have the ability to improve the design of the relevant proprietary products of the company, and possess the capabilities of the overall design of proprietary products, trial assembly of product trials, and special test verification.

2. Product capacity and conditions

The subordinate enterprises shall have the full capabilities of the requirements for “Production Capacity and Conditions of Products” in the “Entry Conditions”.

However, for components of the platform products, such as automobile chassis, truck cab, etc., if the enterprise group manufactures the stamping, welding, painting, etc., it can simplify the related capacity requirements of the subordinate enterprises.

3. Product consistency assurance ability

The subordinate enterprises shall have the comprehensive capability required by the "V. Production Consistency Guarantee Ability" of the "Access Conditions" and be able to implement them independently.

However, among the inspection capabilities, work involving periodic spot checks, type inspections, etc. can be completed by the enterprise group.

The parts and components of the shared product platform can be implemented under the unified management, unified evaluation and unified requirements of the enterprise group. The exclusive products of subordinate enterprises shall be formulated by the subordinate enterprises themselves, and their own assessment shall be made and the supporting enterprises shall be designated.

4. Product marketing and after-sales service capabilities

The enterprise group can unify sales channels and provide universal services. The exclusive products of subordinate enterprises shall be provided by subordinate enterprise personnel to provide special services.
