The Kane County Chronicle recently published an article discussing a potential expansion of the Fox River and Countryside Fire/Rescue District, which could come at the expense of the Elburn and Countryside Fire Protection District. According to court documents dated July 17, local voters have taken steps to petition for the removal of certain land from the Elburn district and its addition to the Fox River district.
Pat Griffin, an attorney representing the Fox River district, outlined the boundaries of the proposed territory. He stated that the area is bordered by LaFox Road to the east, Anderson Road to the west, Campton Hills Road to the south, and Empire Road to the north. Some agricultural land just north of Silver Glen Road is also included in the proposal.
Griffin noted that approximately 128 residents signed the petition, although the population of the area is estimated to be around 3,000. This petition serves as a way for voters to bring the issue before the public on the November 4 ballot. A judge must review the petition and assess several key factors, including whether the new territory would receive equivalent fire services from the Fox River district and whether the disconnection would cause significant harm to the Elburn district.
On August 28, Kane County Circuit Judge David Akemann ruled that the conditions for the transfer were met. However, the Elburn Fire Protection District has raised concerns about the financial impact of the disconnection, arguing that there was little evidence presented regarding how it would affect their expenditures. The court document highlighted this point, noting that very little data was provided on the financial implications for Elburn FPD.
Only residents within the affected area will be eligible to vote on the referendum, and a simple majority is required for the disconnection to proceed. The vote will take place during a special board meeting of the Fox River district on September 3, 2014, at 7 p.m.
The questions on the ballot are as follows:
- For making the transfer from the Elburn and Countryside Fire Protection District to the Fox River and Countryside Fire/Rescue District, remaining liable for a proportionate share of the bonded indebtedness outstanding as of the date of disconnection, if any, of the district from which disconnection is proposed and also assuming a proportionate share of the bonded indebtedness, if any, of the district to which transfer is proposed.
- Against making the transfer from the Elburn and Countryside Fire Protection District to the Fox River and Countryside Fire/Rescue District, remaining liable for a proportionate share of the bonded indebtedness outstanding as of the date of disconnection, if any, of the district from which disconnection is proposed and also assuming a proportionate share of the bonded indebtedness, if any, of the district to which transfer is proposed.
This development is being closely watched by local officials and residents, as it could significantly impact the structure and funding of the fire protection districts in the area.
Thanks, Dan.
