Petition circulated to change fire districts

The Kane County Chronicle recently published an article discussing a potential expansion of the Fox River and Countryside Fire/Rescue District, which could come at the expense of the Elburn and Countryside Fire Protection District. According to court documents dated July 17, local voters have petitioned to remove a portion of land from the Elburn and Countryside district and assign it to the Fox River district. Pat Griffin, an attorney representing the Fox River district, outlined the boundaries of the proposed territory: it is bordered by LaFox Road to the east, Anderson Road to the west, Campton Hills Road to the south, and Empire Road to the north. Some agricultural land just north of Silver Glen Road is also included in the area under consideration. Griffin noted that approximately 128 residents signed the petition, though the population in that area is estimated to be around 3,000. The petition serves as a formal mechanism for voters to bring the issue of disconnection before the public on the November 4 ballot. A judge must review the petition and evaluate several key factors, including whether the affected area would receive comparable fire services from the Fox River district and whether the disconnection would cause significant harm to the Elburn district. On August 28, Kane County Circuit Judge David Akemann ruled that the conditions for transfer and disconnection had been met. In the court document, it was mentioned that the Elburn Fire Protection District argued there was insufficient evidence to show that their expenditures would be adjusted proportionally to account for the loss of revenue. In fact, very little data was provided by either side regarding the financial impact of the disconnection. Only the residents within the disputed territory will be eligible to vote on the matter, and a simple majority is required for the disconnection to proceed. The referendum will be discussed during a special board meeting of the Fox River district scheduled for 7 p.m. on September 3, 2014. The questions on the ballot are as follows: - For making the transfer from the Elburn and Countryside Fire Protection District to the Fox River and Countryside Fire/Rescue District, remaining liable for a proportionate share of the bonded indebtedness outstanding as of the date of disconnection, if any, of the district from which disconnection is proposed, and also assuming a proportionate share of the bonded indebtedness, if any, of the district to which transfer is proposed. - Against making the transfer from the Elburn and Countryside Fire Protection District to the Fox River and Countryside Fire/Rescue District, remaining liable for a proportionate share of the bonded indebtedness outstanding as of the date of disconnection, if any, of the district from which disconnection is proposed, and also assuming a proportionate share of the bonded indebtedness, if any, of the district to which transfer is proposed.
